The Directorate of Enforcement (ED) Patna has provisionally attached properties worth Rs. 67.56 crore in connection with money laundering case against M/s Broadsons Commodities Pvt Ltd.
The officials said that the said properties were acquired by Subhash Prasad Yadav (ex-Director of M/s Broadsons Commodities Pvt Ltd) and Ashok Kumar (Director of M/s Broadsons Commodities Pvt Ltd) under the PMLA, 2002,
The immovable properties are located in Patna (Bihar), Dehradun (Uttarakhand) and Ghaziabad (Uttar Pradesh).
ED initiated investigation on the basis of 20 FIRs registered by Bihar police under various sections of IPC, 1860 and Bihar Mineral (Concession, Prevention of Illegal Mining, Transportation & Storage) Rule, 2019 against M/s Broadson Commodities Private Limited and others. It is alleged that M/s Broadson Commodities Private Limited has been involved in illegal Sand Mining and selling of sand without using the departmental Pre-paid transportation E-Challan, issued by the Mining Authority, Bihar and has caused huge revenue loss to the extent of Rs. 210.68 crores to the Government Exchequer.
The investigation revealed that the illegal sale of sand and its mining was mainly controlled by a syndicate. Subhash Prasad Yadav and Ashok Kumar, being syndicate members, generated huge Proceeds of Crime (POC) through M/s Broad Son Commodities Private Limited which was involved in illegal sale of sand. Subhash Prasad Yadav layered and laundered the POC by acquiring three land parcels in Sampatchak, Patna worth Rs. 44.32 crores in the names of companies controlled by him.
Ashok Kumar layered and laundered the POC by acquiring a boarding school in Dehradun worth Rs. 22.68 Crore run by a society where his son is President and alsocarrying out constructions in the school in Ghaziabad run by his family owned trust. They used the façade of companies, society and trust owned/controlled by them and their family members to layer the POC and projected the same as untainted, officials informed.
The ED has provisionally attached two immovable properties to the extent of Rs. 26.19 crores acquired by Radha Charan Sah, MLC, Bihar Legislative Council under the PMLA, 2002.
