The Delhi Police probing Swati Maliwal assault case have found that accused Bibhav Kumar had formatted his phone and is not cooperating in the investigation.
The police arrested Bibhav Kumar on May 18 after Maliwal accused him of assaulting her at the Chief Minister's residence on May 13. Three days after the alleged assault, Maliwal had finally filed a complint with Delhi Police.
Kumar was reportedly in Mumbai a day before his arrest and allegedly formatted his phone there. The police team is likely to seek the help of a forensic expert to retrieve data from Bibhav Kumar's phone.
The police found that the evidence could have been tampered with as the CCTV footage at Chief Minister Arvind Kejriwal's residence at the time of the alleged assault was showing blank. The police later collected more footage and evidence from Kejriwal's residence after recreating the “crime scene”.
Three days after the alleged incident, the AAP released a video shot on a mobile phone where Maliwal can be seen arguing with the security guards at the Chief Minister's residence. She can be heard threatening the guards with police action, and dares them to throw her out.
